Terms & Conditions

These Terms and Conditions apply to all driving tuition and related services provided by EXL Driving School. By booking, paying for, or attending lessons, the pupil confirms that they have read, understood, and agreed to these Terms and Conditions.

1. Driving Licence Requirements

All pupils must be of the legal age to drive and must hold a valid UK or Northern Ireland Provisional Category B Driving Licence.

The instructor reserves the right to request sight of the licence at any time. Lessons may be refused or cancelled if a valid licence cannot be produced.

For Motorway, Pass Plus, or Refresher lessons, pupils must hold a valid full UK driving licence.

Pupils must meet the minimum legal eyesight requirement. If glasses or contact lenses are required to meet this standard, they must be worn at all times while driving.

2. Fitness to Drive

Pupils must not attend lessons while under the influence of:

  • Alcohol

  • Illegal drugs

  • Medication that may impair driving ability

Any medical condition or medication that could affect safe driving must be disclosed to the instructor and reported to the DVLA where legally required.

The instructor has the sole discretion to terminate or refuse a lesson if they believe the pupil is not fit to drive safely. In such circumstances, the lesson may still be charged in full.

3. Changes to Licence Status or Health

The pupil must notify the instructor immediately of any change that may affect their legal entitlement or ability to drive, including:

  • Licence suspension or revocation

  • Medical conditions affecting driving

  • Changes to eyesight

Failure to disclose such information may result in immediate termination of lessons without refund.

4. Lesson Times

Lessons will begin at the agreed scheduled time when the pupil enters the vehicle.

If the pupil arrives late, the lesson will still finish at the original scheduled end time unless otherwise agreed.

5. Pupil Non-Attendance

If the pupil fails to attend the agreed meeting point:

  • The instructor will wait for up to 15 minutes

  • Reasonable attempts will be made to contact the pupil

If the pupil does not attend or cannot be contacted within this period, the lesson will be considered a late cancellation and charged in full.

6. Instructor Delays

In the event that the instructor is delayed due to circumstances beyond their control, reasonable efforts will be made to:

  • Extend the lesson time, or

  • Rearrange the lost time for a future lesson.

7. Lesson Cancellations

Pupils must provide a minimum of 48 hours’ notice to cancel or rearrange a lesson.

Failure to provide sufficient notice will result in the full lesson fee becoming payable.

The instructor reserves the right to cancel lessons due to:

  • Illness

  • Mechanical failure

  • Adverse weather conditions

  • Road safety concerns

  • Other unforeseen circumstances

Where possible, alternative arrangements will be offered.

8. Payment Terms

All lessons must be paid for in advance or at the start of the lesson, unless another arrangement has been agreed.

Accepted payment methods include:

  • Cash

  • Bank transfer

  • Debit card

Any outstanding balances remain the responsibility of the pupil and must be settled within 30 days.

9. Block Bookings

Discounts offered for block bookings apply only where full payment is made in advance.

Block booking lessons should normally be used within six months of purchase.

Unused lessons beyond this period may be subject to current lesson pricing.

Block bookings are non-transferable unless otherwise agreed by EXL Driving School.

10. Driving Tests

A separate fee applies for the use of the instructor’s vehicle during a driving test.

The instructor must be satisfied that the pupil has reached a safe and appropriate test standard before allowing the use of the vehicle.

The instructor reserves the absolute right to refuse the use of the vehicle for a driving test if they believe the pupil has not reached the required standard.

11. Failed Driving Tests

Following an unsuccessful driving test, the instructor may require the pupil to complete additional tuition (normally a minimum of five hours) before permitting the use of the training vehicle for another test.

12. Driving Offences

The pupil is responsible for any driving offences, penalties, fines, or fixed penalty notices incurred while they are in control of the vehicle.

13. Vehicle Damage

The training vehicle is insured for driving tuition.

However, the pupil may be responsible for any uninsured losses, insurance excess charges, or damage caused through negligence or failure to follow the instructor’s guidance.

14. Driving Test Cancellations

EXL Driving School cannot be held responsible for driving tests cancelled by the DVSA, including those due to weather conditions, examiner availability, or administrative reasons.

If a test is cancelled due to the condition of the instructor’s vehicle, reasonable reimbursement may be provided at the instructor’s discretion.

15. Late Payments

EXL Driving School reserves the right to apply a 1% daily surcharge to any outstanding balance remaining unpaid after 30 days from the original lesson date.

16. Refund Policy

Prepaid lessons, block bookings, and intensive course deposits are non-refundable, except where EXL Driving School decides otherwise at its discretion.

17. Lesson Vouchers

Lesson vouchers are valid for six months from the date of issue.

After this period they may only be honoured at the discretion of EXL Driving School, and any applicable price increases may apply.

18. In-Car Cameras / Dashcams

For safety, training, and insurance purposes, the training vehicle may be fitted with forward-facing and/or interior dash cameras.

Footage may be used for:

  • Insurance claims

  • Incident investigation

  • Training review and feedback

All recordings are stored and processed in accordance with UK data protection legislation.

19. Safeguarding and Behaviour

EXL Driving School is committed to maintaining a safe, respectful, and professional learning environment.

Lessons may be terminated immediately if a pupil:

  • Uses abusive or threatening language

  • Behaves inappropriately or aggressively

  • Refuses to follow safety instructions

  • Puts themselves, the instructor, or other road users at risk

Where lessons are terminated due to behaviour, any prepaid lessons may be forfeited.

20. Data Protection (GDPR)

EXL Driving School will collect and store limited personal information necessary to provide driving tuition, including:

  • Name

  • Contact details

  • Driving licence information

  • Lesson records

This information will be used solely for administration, lesson scheduling, and communication purposes.

All personal data is handled in accordance with the UK General Data Protection Regulation (UK GDPR) and will not be shared with third parties unless required by law.

21. Liability

EXL Driving School and its instructors shall not be liable for any loss, injury, damage, or costs suffered by the pupil except where such liability cannot legally be excluded under UK law.

Nothing in these Terms affects the pupil’s statutory rights.

22. Complaints Procedure

If a pupil has a complaint, they should first attempt to resolve the matter directly with their instructor.

If the issue cannot be resolved, complaints may be submitted in writing to:

23. Amendments to Terms

EXL Driving School reserves the right to update or amend these Terms and Conditions at any time. Updated terms will apply to all future bookings.
